Consent Decree Reservation of Rights

Description: A consent decree is a settlement agreement approved and enforceable by the court. Many settlement agreements with the EPA result in consent decrees. However, under a consent decree the government will reserve its right to bring actions on the underlying complaint if a party fails to abide by the settlement terms. This form is a sample reservation of rights clause from a consent decree.
